We professionally and quickly prepare technical documentation for the legalization of illegally constructed buildings throughout Croatia.
The deadline for submitting applications under the Act on the Treatment of Illegally Constructed Buildings is 30.06.2013, and the deadline for submitting applications for illegally constructed buildings for which an inspection procedure is being conducted is 31.12.2012.
ACT ON THE PROCESSING OF ILLEGALLY CONSTRUCTED BUILDINGS
On 4 August 2012, the new Act on the Treatment of Illegally Constructed Buildings (OG 86/12) entered into force, which provides for a new deadline for submitting applications of 30 June 2013, after which applications will no longer be able to be submitted.
For illegally constructed buildings for which the building inspector has issued a decision to remove them by the date of entry into force of the new law, the deadline is December 31, 2012.
AN ILLEGALLY CONSTRUCTED BUILDING is a building or reconstructed part of an existing building constructed without a building permit or constructed in violation of a building permit, with at least rough construction works (foundations with walls, columns with beams and a ceiling or roof structure), with or without a roof, of at least one floor, and which must be visible on a digital orthophoto map at a scale of 1:5000 of the State Geodetic Administration, produced on the basis of aerial photogrammetric survey of the Republic of Croatia, from June 2011.
If the request is not submitted by the end of the deadlines, buildings for which a decision on the constructed condition has not been issued will not be able to be used, reconstructed (extended and upgraded) or connected to municipal water structures, the electricity grid and other infrastructure, and a decision to perform construction work will not be issued for it. activities under a special law, and will not be able to be recorded in the cadastral register and entered in the land books.
The legalization procedure is now simpler and cheaper for applicants.
The new law divides buildings into 4 groups according to their complexity:
1. Complex building – a building larger than 400 m2, a building for exclusively agricultural activities larger than 1,000 m2 and a building for public purposes regardless of its area.
2. Less complex building – a building smaller than 400 m2, and a building for exclusively agricultural activities smaller than 1,000 m2.
3. Simple building – a building with a gross area not larger than 100 m2 and a building for exclusively agricultural activities smaller than 400 m2.
4. Auxiliary building – a building smaller than 50 m2, which has one floor and which functions as a main building, if the main building has an act on the basis of which it was built or other evidence that the main building was legally built.
AMOUNT OF THE FEE
The amount of the fee is prescribed depending on the size, location (position in space) and purpose of the building, as well as the method of payment of the fee and other criteria, by Government regulation.
When submitting an application for legalization of a building, the applicant must state in writing which method of payment of the fee he/she chooses, i.e. declare whether he/she intends to pay the fee in installments or in a lump sum, indicating the repayment period. If the applicant does not state in writing the method of payment of the fee, i.e. if the established amount of the fee is 1,500.00 kuna or less, the administrative body shall issue a decision with a lump sum payment. In the case of a lump sum payment of the fee, the taxpayer is granted a 25% discount on the amount of the fee, provided that the amount of the fee with the calculated discount cannot be less than 500.00 kuna per building.
MUNICIPAL AND WATER CONTRIBUTION
Applicants, i.e. owners of a building for which a decision on the completed condition has been issued, except for an auxiliary building, are obliged to pay the utility and water contribution in accordance with special regulations, in proportion to the co-ownership of the building, i.e. the size of their separate part of the building or the size of the functional unit they use, upon the enforceability of that decision.
